What to do When Facing an Employment Tribunal

Regardless of how well your company is run or how successful you are operating, there is always the chance of an employee attempting to take legal action against you.

Some employees are even recording conversations in the hope that there will be evidence that aids them in taking employment action. With the Scottish Government planning to scrap employment tribunal fees that were keeping the number of claims in check north of the border and with debate still ongoing regarding employment tribunal fees in England & Wales, there is a high chance that you could face an employment tribunal case in the near future. Therefore, there are a number of steps that should be taken if you are faced with an employment tribunal.

Facing an Employment Tribunal Claim

There are many ways that an employee can take employment action whether it be over pay, dismissal, promotion or some harassment or gender discrimination. If possible, try and resolve the case outside of court allowing you to work with the employee to resolve any concerns.

If it is impossible to solve the issue through conciliation, it is important to have as much evidence as possible that backs up your case. Working through an employment tribunal can be exceptionally time consuming and while it is important to have as much evidence as possible, it is also vital to enlist the help and support of a skilled solicitor who knows exactly what is needed and what is the best way to proceed with the evidence you have.
